Welcome to CigarSnap. Please read these Terms of Service ("Terms") carefully before using our mobile application.

1. Acceptance of Terms

By downloading, installing, or using CigarSnap, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the application.

2. Description of Service

CigarSnap is a mobile application that provides:

• AI-powered cigar band identification
• Digital humidor management
• Tasting journal functionality
• Smoke session tracking
• Social sharing features
• Achievement and badge system

3. Age Verification

CigarSnap is intended exclusively for adults aged 21 and older. By using this application, you represent and warrant that:

• You are at least 21 years of age
• You are legally permitted to use tobacco products in your jurisdiction
• You will not allow anyone under 21 to use your account or access the application through your device

We reserve the right to terminate accounts if we have reason to believe the user is under 21 years of age.

4. User Accounts

To access certain features, you may need to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

5. Subscription Terms

Free Tier

The free version of CigarSnap includes:

• 5 cigar scans per month
• Up to 10 cigars in your humidor
• Basic tasting journal
• Smoke session tracking

Premium Subscription

CigarSnap Premium is available as:

• Monthly subscription: $9.99/month
• Annual subscription: $49.99/year (best value)

Billing

• Subscriptions are billed through your Apple App Store or Google Play Store account
• Payment will be charged at confirmation of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period

Cancellation

• You may cancel your subscription at any time through your App Store or Play Store account settings
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial subscription periods
• After cancellation, you will retain access to Premium features until the end of your paid period

6. AI Identification Service

Our AI-powered cigar identification feature:

• Provides identification based on image analysis and is not guaranteed to be 100% accurate
• Should not be relied upon as the sole source of information for purchasing decisions
• May not recognize all cigar brands or limited editions
• Processes images through third-party AI services (Anthropic Claude)

7. User Content

You retain ownership of content you create (notes, ratings, photos). By using CigarSnap, you grant us a license to:

• Store and process your content to provide the service
• Display your content to you across your devices
• Use anonymized, aggregated data to improve our services

8. Prohibited Conduct

You agree not to:

• Use the service if you are under 21 years of age
• Share your account with anyone under 21
• Attempt to reverse engineer or hack the application
• Use the service for any illegal purpose
• Upload malicious content or attempt to disrupt the service
• Violate any applicable laws or regulations

9. Intellectual Property

CigarSnap and its original content, features, and functionality are owned by CigarSnap and are protected by international copyright, trademark, and other intellectual property laws.

Cigar brand names, logos, and trademarks referenced within the app are the property of their respective owners. CigarSnap is not affiliated with or endorsed by any cigar manufacturer unless explicitly stated.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The service will be uninterrupted or error-free
• AI identification results will be accurate
• The service will meet your specific requirements
• Any stored data will never be lost

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CIGARSNAP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of data or content
• Loss of profits or revenue
• Purchasing decisions made based on AI identification
• Any damages arising from use or inability to use the service

12. Indemnification

You agree to indemnify and hold harmless CigarSnap and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the service or violation of these Terms.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms and updating the "Last Updated" date. Your continued use of the service after such changes constitutes acceptance of the new Terms.

14. Termination

We may terminate or suspend your account and access to the service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the service will immediately cease.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
